GPL Unconstitutional?

In yet another ridiculous legal saga, Utah's SCO Group has asked a federal judge to declare that the general public license of the Linux computer operating system is unconstitutional and unenforceable.

The Lindon-based company made the motion as part of its request that U.S. District Judge Dale Kimball dismiss IBM's 3-month-old countersuit.

In its August countersuit, IBM denied SCO's allegations in its $50 billion March lawsuit that SCO's proprietary Unix code had been illegally incorporated into IBM's versions of the freely distributed Linux. IBM also accused SCO of breaking IBM patents, breach of contract, unfair competition, deceptive trade practices and violation of the Linux public development and distribution license.

In its response, SCO attacked the GPL.

"Apart from the patent issues, SCO views the GPL issues as much more significant," company spokesman Blake Stowell said Tuesday. "SCO's copyrights still stand. Congress has drawn a boundary between proprietary and open source."

IBM spokesman Mike Darcy would only say that his company "strongly believes in its counterclaims and looks forward to trying its case in the court of law."

However, open-source spokesman Bruce Perens, a Berkeley, Calif., Linux developer, blasted SCO's challenge to the GPL's constitutionality as being "way over the top."

Perens contended the enforceability of the GPL has withstood past court scrutiny, and he said SCO's filing was "just an attempt to delay the inevitable day that the case gets thrown out of court."

SCO argued that the chief enforcer of the GPL — the open-source community's Free Software Foundation — has been so selective and inconsistent as to render the license "barred as a matter of equity."

SCO contended that use of the license violates standing federal copyright, antitrust and export-control laws.

SCO, which is also being sued by leading Linux distributor Red Hat, filed its response late Friday.

Panther's coolest features

In addition to Panther's major enhancements, there are lots of tiny improvements that show Apple's attention to detail and make it much more pleasant to use. Here are a few of my favorites.


  • In Mail.app, clicking on the reply or forward indicator next to a message will open the related message.


  • If you use the terminal, there's now a Connect To Server command, which lists ssh, telnet, ftp, and other servers on your local network. Terminal also has a dock menu, which includes that command.


  • If you use X11, it also has a dock menu now, which lists all of the windows and lets you start X applications.


  • System Preferences now has a dock menu which lets you go to any panel instantly.


  • You can now run Software Update directly from the Apple menu.


  • For drives which support S.M.A.R.T. diagnostics, Disk Utility will show their status and warn of impeding failure if you click on the drive icon.

Recovering from a corrupted netinfo database

Before installing Panther on my PowerBook, I backed up the drive to an external FireWire drive with Carbon Copy Cloner. When I tried to boot that drive, however, I found that I was dumped to the login screen and my password didn't work. Here's how I recovered it.

First, boot into single user mode by holding down Command-S while booting. You'll get a black text screen with a shell prompt.


Make your disk writable by typing /sbin/mount -uw /


Next, delete the netinfo database with the following commands:


cd /var/db/netinfo

rm -r local.nidb

Finally, continue booting by typing Control-D. When you get to the finder, the setup assistant will run as it does for a new installation. You'll have to create a new user, but your old home directory will still exist and you can access it and change the password from the Accounts system preference panel.

Security Update 2003-10-28 for Panther

Apple Releases Darwin 7.0 Source Code

Apple has released the source code for Darwin 7.0, which corresponds to Mac OS X 10.3.


The released version of each Darwin project is available to browse or download as a source archive. To browse the sources click on the project name in the list on Apple's Darwin project page. To download a source archive, click on the ".tar.gz" in the same row as the project.

Hidden Exposé blob

Panther's dock has a hidden feature that will display a floating blue 'blob' that activates Exposé if you click on it. The hint was posted in macosxhints a few days ago and now If Then Software has written a free utility to enable or disable the feature.

Apple rips off Proteron?

Proteron has posted the following open memo to Apple, in response to a particluar Panther feature:


Dear Steve et al at Apple Computer,


Congratulations on the recent hardware announcements and release of Panther. Apple continues to innovate in the world of personal computers. Thanks for all the hard work. Our lives are a bit better and brighter for your efforts.


There is, however, one issue I must raise. It is regarding a specific feature introduced in Panther. As you are aware, keyboard application switching is significantly improved. What is disappointing is that this "improvement" is a near pixel duplication of a Proteron product, LiteSwitch X. And despite the obvious similarities, Proteron has received no recognition or credit.


This memo is written for two reasons. First, to request that Apple officially recognize that LiteSwitch X played a role in the formation of Panther's switcher. For tens of thousands of users the feature has existed since May 2002. A developer at Proteron first conceived of it. Proteron developed and published it. Now Apple has made it their own, an "Apple innovation", without recognizing Proteron.


This memo is also written to publicly highlight your behavior and request more of an explanation. What happened with LiteSwitch X is a repeat of recent Apple history, ala Sherlock 3 and Karelia's Watson. You have again absorbed a third-pary innovation into the OS without crediting the original authors. Why not give credit to your developers? Does Apple lose anything? Does it hurt Apple or the Mac OS to recognize that a someone's ideas are so good they belong in the Mac's core feature set? Is there any harm in hailing the achievements of the "little guy"?


We're flattered by the imitation. And we don't blame you for incorporating great features into the OS - it is good for Mac users everywhere. But it is definitely going to hurt our bottom-line during hard times. And we don't even get credit for our work.


I feel that what Apple has done by incorporating third party features into the Mac OS without recognition is both disappointing and dishonest. I invite you to change your approach. There is no shame in recognizing quality work whenever and wherever it appears, especially when it is coming from within the Mac community. We love what you've done with Panther. We love developing for the Mac. As you continue to innovate, please recognize those who have helped you. It's a basic courtesy: give credit where credit is due.

Panther upgrade notes

Although I've been running Panther on my G4 minitower for a while, I waited until this afternoon to install it on my PowerBook, which is my production machine. Here are some tips for making the upgrade as smooth as possible.


  • If possible, install on a separate drive or partition. If you have more than one machine, test it thoroughly on a less critical system before you install it on one you depend on.

  • I highly recommend doing an archive install, preserving user settings. You'll end up with a clean system with all of your data & custom applications intact.

  • If you're using a version of Default Folder earlier than 1.9, upgrade BEFORE installing Panther. I learned this the hard way on my G4 - if Default Folder 1.8 is installed, bad things (such as the finder repeatedly crashing & relaunching) will happen when you boot Panther. Version 1.9 fixes this problem and makes it fully compatible.

  • Make sure any applications you depend on work in Panther. If you're using a VPN connection, make sure you can still connect to your VPN server.

  • If you do software development, especially if you're working on multiple programmer projects, make sure you remain compatible with everyone else. If the other programmers are still using 10.2, use ProjectBuilder (which is fully compatible with Panther) instead of XCode. If you do use XCode, force it to use GCC 2.95 or 3.1 using the gcc_select command (type 'gcc_select --help' in the terminal for more info).


By taking these precautions, your upgrade can be painless with little or no downtime.

Apple introduces G4 iBooks

Apple today introduced new G4 based iBooks, starting at $1099, making it the lowest priced G4 laptop ever.

The new iBook is available in 12" and 14" models.
The 12.1-inch iBook gives you a 800MHz PowerPC G4 processor, a 133MHz system bus and 256MB of DDR SDRAM. The 14.1-inch iBook packs a powerful punch with either a 933Mhz or 1GHz PowerPC G4 processor and 256K on-chip level 2 cache running at full processor speed, a 133MHz system bus and 256MB of DDR SDRAM. All models support expansion up to 640MB of RAM, and come with the ATI Mobility Radeon 9200 graphics processor with 32MB of dedicated video memory and AGP 4X suppor.

Rogue Amoeba Audio Software Updates

Rogue Amoeba has today released Detour 1.2, with support for OS X 10.3 (Panther) and Unsanity's Xounds 2.1 (Coming soon).

New Music Tuesday - Oct. 21, 2003

Despite the FUD* from Microsoft's Dave Fester (what a great name), Windows users downloaded 1 million copies of iTunes and bought 1 million songs in only 3 days. Following one of the biggest weeks ever, today's new additions were pretty light, so I'll focus on celebrity playlists and some older gems today.

My first choice is Sting's Playlist, hilighting Shaking the Tree, by Peter Gabriel.


Herbie Hancock's Playlist has some interesting selections, especially
Bitches Brew, by Miles Davis (which iTMS often renders as B***es Brew), one of the most important albums ever, which paved the way for all jazz/rock fusion artists.


After listening to Joe Stummer's final album, streetcore, non-stop for the last two weeks, it's time to dig out more Clash albums. Start with The Essential Clash and The Singles. Don't miss
Sandanista! (Remastered), their most heavily Reggae-influenced album.


For jazz fans, check out Electro Bamako, by Malian singer Mamani Keita, who I never heard of before I previewed this one in new releases, and
Verve Remixed 2, which features electronic dance remixes of jazz standards.

SideTrack 0.7.2

Raging Menace has released a public beta of SideTrack, a replacement trackpad driver for PowerBooks & iBooks.

SideTrack brings many of the trackpad scrolling features found on Windows laptops to MacOS X. Most Windows laptops implement trackpad scrolling using drivers made by Synaptics. Although Apple PowerBooks also use Synaptics trackpads, the standard Apple driver uses none of the extended features.


SideTrack supports these features: Vertical scrolling at left or right edge of pad; Horizontal scrolling at top or bottom edge of pad; Map hardware button to left or right click; Map trackpad taps to no action, left click, left click drag (with or without drag lock), or right click.


Although I normally use a mouse with my 12" PowerBook, I find the scrolling features a welcome addition for those times when I'm working unplugged.

Web Dumper 1.8.1

Maxprog is proud to present another update of its web tool product named 'Web Dumper' a full featured internet tool that allows users to download web sites for offline browsing. Available in English, French and Spanish.

If you are viewing a Web site with your browser and you decide that you would like to make a copy of it on your hard drive, you have to manually save each page as you view it along with embedded pictures, sounds and so on. This can be a very long and tedious process, and in many cases it's more trouble than it's worth. It doesn't have to be that way, however, as Web Dumper makes this whole process very fast and easy.



With Web Dumper you can download entire Web sites off of the Internet, and save them on your hard drive for later offline browsing. Downloaded Web sites are saved on your hard drive with their directory structure intact. First Animated Keynote Theme Released

Global, an update from Keynote Theme Park , is the first theme to incorporate an animation in the background.

First look at iTunes for Windows

Since I have access to a Dell Laptop, I decided to try out iTunes for Windows. Here are my impressions as a Mac user.

The first thing I notice is that iTunes for Windows looks and works exactly like iTunes for the Mac, yet it doesn't feel out of place on the PC. The window & menu arrangement is almost identical to the Mac, although the menus are located in the window, in standard Windows fashion.






iTunes for Windows also includes an icon in the system tray, which lets you play, pause, rate songs, and change some options. Windows & Mac versions of iTunes can share their playlists - the PC had no trouble seeing my Mac servers, and my Macs are able to see and play music from the PC.


When I insert a CD on the PC, a popup window gives me the option to play it in Windows Media Player or iTunes. When I open it in iTunes, I'm able to import it quickly & easily with speeds up to 9x on the Dell Inspiron 4100.


iTunes for Windows feels very fast & snappy. It's one of the best Windows applications I've seen and one of the first that truly combines the best of both worlds.


The iTunes download also installs QuickTime for Windows and places both iTunes and QuickTime Player shortcuts on the desktop.

iTunes 4.1 & iPod Software 2.1

Apple's music event today announced the release of iTunes for Windows, as well as new features for the iTunes Music store, new iPod peripherals, and software updates for iTunes and the iPod.

iTunes 4.1 lets you share music between Mac and Windows computers, buy Audible spoken word content from the iTunes Music Store using your Apple Account, synchronize On-The-Go playlists and voice notes created on your iPod, burn large playlists on multiple discs without interruption, and drag URLs from the Music Store to an email or other program.


iPod Software 2.1 supports only iPods with a dock connector and adds the following new features:


  • Better default contrast setting
  • Added Voice Memos application (requires optional iPod-compatible microphone, available at www.apple.com/store)
  • Added digital photo storage functionality (requires optional iPod-compatible photo card reader, available at www.apple.com/store)
  • Enhanced On-The-Go playlist functionality
  • Improved playback performance
  • Added Music Quiz game
  • Improved backlight functionality
  • Improved battery meter

Both updates, as well as QuickTime 6.4, which includes a number of audio and performance enhancements, are now available via the Software Update panel.


Among the hilights of today's event:

New Mozilla Releases

Mozilla.org has released 3 major updates: Mozilla 1.5, Mozilla Firebird 0.7, and Thunderbird 0.3.

Mozilla 1.5 is the familiar all-in-one application with a web browser, email & news client, and web authoring tool.


Firebird 0.7 is a pleasant surprise. This new release is fast, and is finally a usable browser. It's starting to become my favorite browser due to its speed.


Thunderbird is a stand-alone mail & news client based on the ones included with Mozilla.


Meanwhile, the Camino developers are still working on a new release & nightly builds.

Bluetooth Firmware Updater 1.0.2

Apple has released a firmware updater for D-Link USB Adapters and internal Bluetooth modules on PowerBooks and PowerMacs to improve connectivity between the computer and the Apple Wireless Keyboard and Mouse.

The Bluetooth Firmware Updater 1.0.2 provides improvements in the update installation process, better performance when waking the computer from sleep, and support for additional key commands during startup.


The Bluetooth Firmware Updater 1.0.2 is for D-Link USB Adapters (revision B2 or later), and Apple internal Bluetooth modules on PowerBooks and PowerMacs. This firmware update will improve connectivity between the computer and the Apple Wireless Keyboard and Mouse. Use this updater for the modules specified above; this updater is unsupported with any other Bluetooth modules.


Important: Using this firmware update will make your Bluetooth module incompatible with Windows based systems.

Apple Reports Fourth Quarter Results

Apple today announced financial results for its fiscal 2003 fourth quarter ended September 27, 2003. For the quarter, the Company posted a net profit of $44 million, or $.12 per diluted share. These results compare to a net loss of $45 million, or $.13 per diluted share, in the year-ago quarter. Revenues for the quarter were $1.715 billion, up 19 percent from the year-ago quarter, and gross margins were 26.6 percent, up from 26.4 percent in the year-ago quarter. International sales accounted for 38 percent of the quarter’s revenues.

The quarter’s results include an after-tax investment gain of $6 million, a favorable accounting transition adjustment of $3 million related to Apple’s stock repurchase agreement, and a gain on settlement of the stock repurchase agreement of $6 million. Without these items, net income would have been $29 million, or $.08 per share. Management believes that presentation of results excluding these items provides meaningful supplemental information regarding the Company’s operational performance.


Apple shipped 787 thousand Macintosh® units during the quarter, up 7 percent from the year-ago quarter, as well as 336 thousand iPod® units, up 140 percent from the year-ago quarter.


“It was a great new product quarter for Apple,” said Steve Jobs, Apple’s CEO. “We launched the Power Mac G5, the fastest personal computer in the world, new PowerBooks and new iPods. Plus, we’re delivering Panther, the next major release of Mac OS X, later this month and we’ll have some exciting news regarding our music efforts tomorrow.”


“We are very pleased to have exceeded our revenue and profit targets for the fourth quarter,” said Fred Anderson, Apple’s CFO. “Our balance sheet remains strong and our working capital management is among the best in the industry. Looking ahead to the first quarter of fiscal 2004, we expect a sequential increase in revenues to about $1.9 billion and a slight sequential increase in GAAP earnings relative to the September quarter.”


For the year, the Company reported net income of $69 million on revenues of $6.21 billion compared to net income of $65 million on revenues of $5.74 billion in 2002.

New Music Tuesday - Oct. 14, 2003

I'm an iTunes Music Store addict. Every week I look forward to Tuesday's new releases. With iTunes for Windows coming Thursday, this promises to be an especially exciting week. Here's a look at today's new additions.

Following last week's addition of Joe Strummer's final album Streetcore, his previous album, Global a Go go has been added. Most of the music is pretty offbeat, but it has some great songs, especially the title song and Bhindi Bhagee.


If you like the blues, don't miss In Session by Albert King & Stevie Ray Vaughan.


For African music fans, Nomad Soul, another great album by Baaba Maal, has been added. Don't miss the first track, which features vocals by The Screaming Orphans, best known as Sinead O'Connor's backup singers.


If you like Sigur Ros (whose music still isn't in the store), check out Mogwai, one of the newly added artists from Matador Records.

Studycard Studio 2.0 offers the ability to print individual cards or multiple cards per sheet, with the question on the front and the answer on the back. Users can even print on perforated card sheets available at most office supply stores. What's more, by printing to a PDF file, users can view and study their cards in a variety of applications, including Acrobat Reader or Keynote, and on different platforms, including Palm OS.



The new version imports and exports text, CSV (comma separated values) and iFlash files encoded as styled text, RTF (Rich Text Format) or Unicode, allowing users to create their cards using virtually any text editor or spreadsheet application. The features allow for exchange between other flashcard applications that support these formats. By selecting a card to use as a template, users can import all their cards preformatted.



Users can also import from EDICT and CEDICT Japanese and Chinese dictionaries and use them to enhance their vocabulary. A variety of these free dictionary files exist on the web for downloading.



The new version has improved performance in order to facilitate importing and studying very large documents such as dictionaries. It can now smoothly handle 100,000 or more cards in a document.



Other new features include, find and replace, resizable thumbnails, and a sort command to order and group cards with a slew of options.

10.2.8 Reducing Processor Speed?

I recently noticed that Xbench as well as a piece of code I'm working on was reporting my 12" PowerBook G4's processor speed as 533 Mhz instead of the expected 866 MHz even though I had full speed selected in Energy Saver. This thread in Apple's discussion forum indicates that it seems to be a widespread problem with 10.2.8. Resetting the PRAM seems to cure it.

ProjectBuilder and Panther

If you're working on a multiple programmer project, it's important for all of the developers to be using the same version of their development environment to avoid conflicts.


I've verified that ProjectBuilder will continue to work with Panther, so it isn't necessary to update to XCode. Although XCode has many advantages, if you have to share your code with other programmers, stay with ProjectBuilder until everyone can update to XCode.

Apple's front page now has a countdown timer and an announcement that Panther will be available at 8PM October 24. According to several rumor sites, build 7B85 or 7B86 has been named golden master, although the latest one available under both of my ADC accounts is still 7B74, which was released several weeks ago.

New Music Tuesday

Every Tuesday I look forward to the new additions in the iTunes Music Store. For the last few weeks, the "Just Added" section of the iTunes Music Store has shown a huge number of new additions. I'll try to make this a regular feature hilighting a few new releases each week.

Today I found that one of my favorite gems was added. Djam Leeli - The Adventurers, by Baaba Maal & Mansour Seck, is a beautiful acoustic album featuring some great guitar work & vocals. It's very reminsicent of Ry Cooder & Ali Farka Toure's "Talking Timbuktu".


Also among the new additions is Streetcore, the final album by Joe Strummer & the Mescaleros (which I bought). It includes a great cover of Bob Marley's "Redeption Song". Interestingly, Joe Strummer mentioned Baaba Maal in the title song of "Global-a-go-go"


If you haven't checked the just added section in iTMS, you'll be surprised by the amount of new music being added every week.

A Backup in your pocket

If you're lucky enough to have an iPod, it also makes a convenient backup device.

Since an iPod also works as an external FireWire drive, you can use it to keep an extra backup of your document folder or even your entire home folder. Higher capacity models, like the latest 40G model, should give you plenty of room for backups.


To use your iPod as a backup device, go to iPod preferences in iTunes and enable FireWire disk mode. Your iPod will appear as a disk in the finder, with a Calendar, Contact, and (if it's a 2.0 iPod) a Notes folder. You can create other folders for your backups.


Popular backup software such as QDea's Synchronize! or LaCie's SilverKeeper can back up to your iPod.


An iPod is also convenient for transporting your essential applications to another system when you don't want to take your PowerBook with you.

Mac OS X 10.2.8 Update re-released

The Mac OS X 10.2.8 update has been re-released, now at build 6R73. The previous 10.2.8 update was build 6R65. This update includes an updated ethernet driver for 450MHz and 500MHz dual processor Power Mac G4 desktop systems and an update to the battery status menu.
